1. Acceptance of Terms

By accessing or using PetsHalo's website, mobile applications, smart collar devices, and related services (collectively, the "Service"), you agree to be bound by these Terms of Service ("Terms"). If you do not agree, do not use the Service.

2. Service Description

PetsHalo provides an IoT-powered pet health monitoring platform that includes smart collar hardware, cloud-based analytics, and companion applications. Our Service collects and processes pet biometric data including heart rate, temperature, respiratory rate, activity levels, and GPS location to provide health insights and alerts.

You are responsible for:

• Providing accurate and complete registration information.
• Maintaining the security of your account credentials.
• All activities that occur under your account.
• Notifying us immediately of any unauthorized access.

You must be at least 16 years of age to create an account. By creating an account, you represent that you meet this requirement.

5. Subscription and Billing

• PetsHalo offers Free, Pro ($9.99/month), and Vet ($29.99/month) subscription plans.
• Paid plans include a 14-day free trial. You will not be charged until the trial ends.
• Subscriptions auto-renew monthly unless cancelled before the renewal date.
• Payments are processed securely by Stripe. We do not store your credit card information.
• Refunds may be issued at our discretion for unused portions of the current billing cycle.
• We reserve the right to change pricing with 30 days' notice. Existing subscribers will be notified before any price change takes effect.

6. Acceptable Use

You agree not to:

• Use the Service for any unlawful purpose.
• Attempt to reverse-engineer, decompile, or disassemble any part of the Service.
• Interfere with or disrupt the Service or servers.
• Share your account credentials with third parties.
• Use automated tools to scrape or collect data from the Service.
• Tamper with or modify the smart collar hardware.

7. Intellectual Property

All content, features, functionality, software, designs, trademarks, and technology of the Service are owned by PetsHalo and protected by intellectual property laws. You may not copy, modify, distribute, or create derivative works without our prior written consent.

You retain ownership of your personal data and pet health data. By using the Service, you grant us a limited license to process this data as described in our Privacy Policy.

8. Limitation of Liability

To the maximum extent permitted by law, PetsHalo shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including but not limited to:

• Loss or injury to pets based on reliance on Service data.
• Inaccuracies in sensor readings or AI-generated alerts.
• Service interruptions, data loss, or hardware malfunction.
• Decisions made based on health insights provided by the Service.

Our total liability for any claim shall not exceed the amount you paid for the Service in the 12 months preceding the claim.

9. Data and Privacy

Your use of the Service is also governed by our Privacy Policy, which describes how we collect, use, and protect your data. By using the Service, you consent to the data practices described therein.

10. Termination

You may terminate your account at any time through your account settings or by contacting support. We may suspend or terminate your access if:

• You violate these Terms.
• Your payment fails and is not resolved within 14 days.
• We are required to do so by law.
• We discontinue the Service (with 90 days' notice).

Upon termination, you may export your data within 30 days. After that period, your data will be deleted in accordance with our Privacy Policy.

11. Changes to Terms

We reserve the right to modify these Terms at any time. We will notify you of material changes via email or through a prominent notice on the Service at least 30 days before the changes take effect. Continued use after changes constitutes acceptance.

12. Governing Law

These Terms are governed by and construed in accordance with the laws of Ukraine, without regard to conflict of law principles. Any disputes shall be resolved in the courts of Kyiv, Ukraine, unless otherwise required by applicable consumer protection laws in your jurisdiction.
